Preliminary Information Form

This Preliminary Information Form has been prepared within the scope of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts for the purpose of informing the Buyer before the establishment of the Distance Sales Agreement between the BUYER (Participant) and the SELLER.

1.2. SERVICE PROVIDER (PARTNER) INFORMATION:

A third-party natural or legal person that personally organizes the Event/Workshop announced on the Platform, determines its content and conditions, and whose trade name, address, and contact information are clearly presented to the BUYER on the relevant Event Detail Page and in the Order Summary.

2. BUYER (PARTICIPANT) INFORMATION

The Buyer is a natural person who creates a participation booking and makes a purchase through atolira.com, either as a registered member or without becoming a member. The name, surname, email address, telephone number, and billing information provided by the Buyer during the order process shall be taken as the basis and shall form an integral part of the booking record.

3. ESSENTIAL CHARACTERISTICS AND BOOKING DETAILS OF THE SERVICE SUBJECT TO THE AGREEMENT

The name, date, time, duration, location, number of participants, unit booking fee, and total sales price of the Workshop/Event for which a booking is created are included in the Order Summary shown to the Customer during the purchase process. The Buyer is responsible for checking the order information before completing the purchase. The Order Summary and participation information are as stated below:

  • Service Description: A booking, reservation, and payment intermediation service that enables participation in a social, educational, and personal-development-oriented leisure activity organized by the Partner.
  • Payment Method: Credit Card / Debit Card (Secure Payment with 3D Secure)
  • Delivery Method: Electronic Delivery (Digital participation confirmation/delivery by email and through the Platform)
  • Invoicing: The booking/service invoice relating to the purchased Event shall be issued by the Service Provider (Partner) in accordance with the applicable legislation and delivered to the BUYER. Atolira shall issue a commission invoice to the Partner in return for the booking payment collection and Platform intermediation services it provides.

4. RIGHT OF WITHDRAWAL AND CANCELLATION / REFUND CONDITIONS

4.1. Exception to the Right of Withdrawal (Legal Information)

Pursuant to Article 15, paragraph 1(g) of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, consumers DO NOT HAVE A STATUTORY RIGHT OF WITHDRAWAL in “contracts relating to accommodation, transportation of goods, car rental, the supply of food and beverages, and leisure activities intended for entertainment or recreation that must be performed on a specific date or within a specific period.”

4.2. Cancellation, Refund, and Change Conditions

  • Although there is no statutory right of withdrawal, the specific cancellation and refund periods expressly stated by the Partner on the relevant Event page, such as the right to cancel 24 or 48 hours before the Event, are reserved. Unless otherwise stated on the relevant Event or Experience page, or after the specified special cancellation period has expired, participation bookings cannot be canceled, refunded, rescheduled, or postponed. Participants cannot directly cancel the bookings they have created through the automated system; all requests must be submitted in writing through Atolira’s support channels within the scope of the announced rules.
  • Non-Attendance and Failure to Participate: No refund or compensatory lesson/Event shall be provided if the Participant arrives late, fails to participate fully or partially, or decides not to participate.
  • Cancellation / Postponement of the Event: If the Event or Experience is completely canceled due to force majeure arising from the Partner or Atolira or due to insufficient capacity, the full booking fee paid by the BUYER shall be refunded without deduction to the card/account used by the BUYER for payment or, upon the BUYER’s written request, replaced with an equivalent alternative Event. The booking fee relating to an approved refund shall be refunded to the card through Atolira’s integrated virtual POS infrastructure. Depending on the banks’ operational processes, it may take between 7 and 14 business days for the amount to appear on the card. Invoicing and accounting processes relating to the refund shall be carried out between the Partner and Atolira in accordance with the applicable legislation.

5. EVENT PARTICIPATION AND SAFETY PRINCIPLES

5.1. Intermediary Position and Payment Collection Authority: Atolira is the Intermediary Service Provider that provides booking and payment collection intermediation services for Events and Workshops. When the BUYER pays the booking fee to Atolira, the payment obligation shall be deemed to have been fulfilled. The Service Provider (Partner) is directly responsible for the Event’s content, venue safety, quality, and operational execution.

5.2. “Who Can Participate” Criteria: Compliance with the “Who Can Participate” criteria announced on the Event page, including age, health condition, and qualification level, is the BUYER’s responsibility. No refund shall be provided to persons who are not admitted to the venue because they do not meet the criteria.

5.3. Public Order and Conduct: Entering the Event venue under the influence of narcotics, stimulants, or alcohol to a degree that disrupts general peace or safety is prohibited. Events that include the serving or tasting of alcohol as part of their concept are exempt from this restriction; however, excessive consumption or disruptive behavior is prohibited. Participants who disturb general peace or fail to comply with the rules shall be removed from the venue, their bookings shall be canceled, and no refund shall be provided.

6. COMPETENT COURTS AND COMPLAINT AUTHORITIES

The BUYER may submit complaints and objections, within the monetary thresholds determined by the Ministry of Trade every December, to the Consumer Arbitration Committee or Consumer Court located where the BUYER purchased the goods or services or where the BUYER resides. The İstanbul (Çağlayan) Courts and Enforcement Offices shall have jurisdiction over commercial and legal disputes arising from the Agreement.

DECLARATION: The BUYER acknowledges, declares, and undertakes in advance that they have read this Preliminary Information Form, understood its content, and proceeded to the payment step by providing the required electronic confirmation.
